The “legislative storm” planned for the next year continues and – to be honest – even we are getting confused by all the amendments. Of course, the amendment of the Labour Code is still the most important item and despite the Senate veto it is almost certain that it will become effective as of 1.1.2012. However, in the shadow of this amendment´s run through the media, there are several amendments to the Act on Employment passing through the Parliament, which will also strongly affect employers´ everyday life. We will try to summarize the most important changes in this issue of HR News. Further, there was some room left for an important case concerning the termination of employment relationship by agreement due to organizational changes. We hope many of you will feel relieved when reading it, because in this respect an invalid termination does not constitute a threat.

HR News No. 5 / August 2011
In the next issue of HR News, we introduced you to the changes, which will affect labour law regulations not only in the Czech Republic, but also in Slovakia and Hungary. Whereas the amendment to the Czech Labour Code is in the first reading in the Chamber of Deputies of the Czech Parliament, in Hungary the amendment has already come into force and in Slovakia its effectiveness is imminent.
In the second part of the August issue of HR News, we focused on the latest judgment of the Supreme Court of the Czech Republic, which concerns the, still widely in use, “švarcsystém“ (i.e. an economic activity where people working for an employer are not his employees, but individual entrepreneurs).

HR News No. 4 / June 2011
In the June issue of HR News, we focused on the proposal of the Act on Specific Health Services as its regulation of occupational medical care will affect all employers. Further, we examined the legislative developments in connection with the planned substantive amendment to the Labour Code, which we had described in the March issue of HR News.
In the part concerning case-law, we looked at two important court decisions: the Czech Supreme Court brought a judgement dealing with the question of concluding working hours in employment agreements. Very interesting is the decision of the Czech Constitutional Court which addressed the place of work and the extent to which it can be agreed.

HR News No. 3 / April 2011
In this issue of HR News the prepared amendment to the Sickness Insurance Act was examined, which put insurance obligations on agreements to complete a job. Thus, the Government, in accordance with its Statement of Purpose, will increase the maximum extent of work performed on the basis of this agreement to 300 hours per year, but at a relatively high price, including considerably more paperwork for employers. Further, we will focus on the amendment to the Act on Employment, which will conversely reduce the administration of employers in connection with reporting of vacancies. However, this amendment also has negative effects, in particular the restraint of employment by agency of third country foreigners.
Also examined in this issue is an interesting decision by the Supreme Court of the Czech Republic, which, after the Labour Code has been in effect for four years, finally decided on the issue whether it is possible to recall an employee who was appointed to a managerial position under the previous Labour Code.

As a response to the 2008 judgment of the Constitutional Court of the Czech Republic, which has cancelled some provisions of the Labour Code, as well as to comply with the government’s Statement of Purpose, the Ministry of Labour and Social Affairs prepared a conceptual amendment to the Labour Code. The proposal of the amendment has been sent to the external comment procedure on 4 March 2011; its effective date is planned for 1 January 2012. You will find a brief overview of the most important practical changes in this issue of HR News.

In this first 2011 issue of HR News, we looked closer at MoLSA’s planned measures against illegal employment. Also, with the start of the new year, it is a good time to remind employers of their regular duties, in particular the contribution to the state budget for not employing the obligatory share of disabled persons. We will also examine an interesting decision by the Supreme Court of the Czech Republic, relating to simultaneous performance of duties of a managing director who is at the same time an employee of the same company.

The third edition of Randls HR News brings information from the last meeting of the Chamber of deputies before the summer break, where MP´s suprisingly adopted the Anti-Discrimination Act as well as expected crisis-fighting proposals. Another rather revolutionary bit of information is the abandonment of obligatory vehicle mileage log. We also draw your attention to a Supreme Court ruling which deals with the loss of a bank´s trust in its employee, which may go so far as a notice of termination. Finally, we discuss two rather interesting possibilities for employers: European Social Fund grants for employee education and to establish company day-care centres.

We bring you the first issue of Randls HR News – a regular update in the field of employment and human resources from the new law firm, Randl Partners. We will issue HR News in more or less monthly intervals, always focusing on current issues in the field of both Czech and European employment law. HR News will primarily discuss prepared legislation, judicial decisions and opinions of relevant institutions. We hope that the information in HR News will be useful for you. In our March news we inform in detail about the conceptual amendment to the Labour Code, the proposal for which was recently presented by the Ministry of Labour and Social Affairs (“MoLSA”). Other legislation discussed is related to the current economic crisis – a government regulation restricting the employment of foreigners, the cancelation of advance payments for income tax for certain persons or changes in social security and health insurance. There is also more positive information about the so-called family package, as the exact wordings of the 5 proposals of new laws / amendments have been presented.
